Credit Counseling – For Consumer Cases Only

The 2005 Amendments to the Bankruptcy Code REQUIRES All consumer debtors to complete TWO credit counseling sessions.

These sessions are provided by professional credit counselors that have been approved by the U.S. Dept of Justice. The typical charge is $50 (single or couple.) There are firms that have lower prices and if your family income is less than 125% of poverty the fees can be waived. By special arrangement Mr. Reizner’s clients can pay $10 or less.

Part One: Pre-Filing Credit Briefing

“The Ticket Into the Park”

The purpose of this “briefing” is to find debtor’s whocan afford to do a non-bankruptcy Debt Management Plan (“DMP”) Congress was lead to believe there were lots of deadbeats abusing Chapter 7 The data and audits done since the law was passed show that was not true
BUT – IT IS STILL THE LAW AND MUST BE COMPLETED BEFORE YOUR CASE CAN BE FILED

The professionals providing the briefings are easy to work with and the briefing can be accomplished:

  • In Person (Only Greenpath provides In-Person briefing in Michigan)
  • Online (see the links below)
  • By Telephone

Each provider is different, but all will look at your income, debts and ability to work out a payment plan. Payment plans are very rare and not mandated.


 

Part Two: Pre-Discharge Debtor Education Course

“The Ticket Out of the Park”

In order to receive a discharge the consumer debtor must, within 45 days of the date set for their court appearance (90 days more or less from the date of the case filing), complete a Financial Management Course AND file a certificate with the court. Failure to complete or file the certificate results in the case being CLOSED WITHOUT A DISCHARGE!

Since most clients need the discharge, this is a serious problem. The case can be re-opened to allow the filing of the certificate, however,the court fee for re-opening is $260. That is a lot of money to pay just to file a couple of sheets of paper.

You can complete your Financial Management Course as soon as the case is filed. Typically you will use the same provider that gave you your initial pre-filing briefing. Use of the same provider, while convenient, is not required. Most of the competition on price is in this second credit management course.
